Terms of Competition

By registering for an event by Keep Pulling through our online registration form, you agree to the following:

I hereby release and agree to hold the Organizers (Keep Pulling, Florida Weightlifting Federation, and USA Weightlifting), its agents and competition personnel harmless from all expenses, causes of action, liability, claims and demands arising from good faith judgments made by the Organizers, its agents and competition personnel concerning my treatment, hospitalization and medical care in the event of my illness, injury or other emergent circumstances in connection with the competition.

I (and my parent or guardian, if I am a minor), agree that I will be financially responsible for treatment, hospitalization and other medical care rendered to me in the event of my illness, injury or other emergency circumstances in connection with the competition, except to the extent my injuries and medical expenses, if any, are covered by accidental death, dismemberment and/or loss of sight and medical reimbursement insurance policies maintained by the Organizers for my benefit, in which event I will nevertheless continue to be financially responsible for expenses of treatment, hospitalization and other medical care in excess of such policies’ limits.

COVID-19 Terms & Acknowledgment

The undersigned (“Athlete”) wishes to participate in training, group classes, private sessions, or other physical fitness related activities at locations owned or leased by or at other locations coordinated through Keep Pulling.

While Keep Pulling is taking proactive measures to ensure the safety and cleanliness of its facility and training area(s), the Athlete hereby acknowledges that Weightlifting or any sporting event is an extreme test of a person’s physical and mental limits and that the Athlete’s participation in or travel to a Weightlifting event may result in death, serious injury or property damage. Furthermore, the Athlete acknowledges that participation in training, group classes, private sessions, or other physical fitness related activities may expose the Athlete to communicable diseases, including, without limitation, viruses such as COVID-19 (a/k/a the Coronavirus), or other illnesses such as the flu.

With a full understanding of the potential risks, the Athlete hereby KNOWINGLY AND FREELY ASSUMES ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES (as described below), and assumes full and sole responsibility for the Athlete’s participation in and travel to such activities and for the safeguarding of the Athlete’s health.

The Athlete, on the Athlete’s behalf and on behalf of the Athlete’s personal representatives, heirs, family members, successors and assigns, hereby: (a) WAIVES, RELEASES, AND DISCHARGES the Released Parties from any and all claims or liabilities for death, personal injury or damages of any kind which arise out of or relate to the Athlete’s traveling to and from or participation in any Weightlifting or other event involving Keep Pulling, (b) AGREES NOT TO SUE any of the Release Parties for any of claims or liabilities arising out of or related to the Athletes’s travel to or participation in Weightlifting or other activities involving Keep Pulling, and (c) INDEMNIFIES AND HOLDS HARMLESS the Released Parties from any claims made or liabilities incurred as a result of the Athlete’s or the Athlete’s family member’s actions.

The “Released Parties” include Keep Pulling, its associations, all event directors, all sponsors, and the owners, managers, officers, directors, employees, sub-contractors, representatives and agents of any of the foregoing, including, without limitation, Patrick Costello, Owner and Club Director of Keep Pulling, and their personal representatives, successors and/or assigns. The Athlete further authorizes the Released Parties to obtain medical treatment in the event the Released Parties or a medical professional deems such treatment to be necessary and acknowledges that the decision to obtain such medical treatment, the treatment and the cost of such treatment are covered by all terms of the foregoing waiver and release.

If Athlete is under 18 years of age, the Athlete’s parent or guardian (“Representative”) has executed this Waiver/Liability Release for and on behalf of the minor. In that event, the Representative hereby binds the Representative, the minor Athlete and all persons claiming by, through or under the Representative or the Athlete to the terms of this Waiver/Liability Release, represents that the Representative has legal capacity and authority to act for and on behalf of the Athlete and agrees to indemnify and hold harmless the Released Parties from any claims or liabilities assessed against them as a result of any insufficiency of the Representative’s legal capacity or authority to act for and on behalf of the Athlete in the execution of this Waiver/Liability Release.
